The Disciplinary Hearing for Andrew Thomas, Lisa Aubuchon, and Rachel Alexander began September 12, 2011 and will determine whether disbarment or any other discipline short of an administrative ‘bitch slap’ will be on the desert horizon for Thomas and his confrères.
But already as predicted at Colorado Attorney Regulation Honcho John Gleason kicks off Andrew Thomas et al. ‘extravaganza, the proceedings are dragging on longer than the time it might take for Howie Mandel to grow back his follicles. Mandel is a judge on that other seemingly never-ending television talent show oxymoronically called “America’s Got Talent.”
Ingesting and digesting.
The hearing broke for lunch. However, since the screws are already being turned, I doubt anyone went hunting for a ham sandwich either to indict or to ingest. But I have to say that from what I’ve seen so far, ole Andy Thomas seems to be holding his own.
Although it clearly shows that he’d rather be anywhere but sitting there in court, he otherwise looks comparatively unperturbed. Granted, I have been multi-tasking while making this assessment. But as a unlathered, non-foaming observer, I don’t see where he’s yet hurt himself. If anything, he’s gotten in a few “corruption” digs at some of his ‘enemies.’
Although Andy Arch-enemy, “The Phoenix New Times” alternative newspaper claims that “unrepentant” Thomas is persisting in “an unshakeable belief in things that seem contrary to established facts,” I actually think he’s doing a better job at parsing his answers than Independent Bar Counsel James Sudler is doing in parsing his questions. See “Thomas Defends Shoddy Conspiracy Case; Struggles to Explain Why “Biased” Judge Ruled in His Favor.”
The other paper with an axe-to-grind against Thomas, “The Arizona Republic,” filed its own morning report on the proceedings and described Thomas as “taciturn” and Sudler as “aggressive.” See “Andrew Thomas: Prosecuting Stapley was nothing personal.”
Both adjectives are misapplied, however. I’m sure that if Sudler gave Thomas free rein beyond just having to answer his questions, I’m afraid Thomas would hardly be reticent. And as for “aggressive,” I think I missed that part. Maybe, I nodded off?
